Terms of Service

Welcome to Lumitone ("we," "us," or "our"), a Deruvish Labs LLC service operated at lumitone.io. By accessing or using our website, services, or purchasing any product (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Service Description

Lumitone is an AI Recommendation Engine. It generates music and film recommendations exclusively from user-provided data: a public profile identifier you enter, the songs and artists you pick by hand, a Letterboxd or IMDb export file you upload, or, if you choose it, a one-time import of your listening (Apple Music in your browser, or a Spotify CSV you upload). An account is optional and never required to use the Service; the optional imports are described in the Privacy Policy and the Apple Music sign-in token never reaches our servers.

The Service operates on a real-time processing basis and keeps no guest inputs. Inputs are processed in memory and deleted after each request. The exceptions are listed exhaustively in the Privacy Policy: purchases (a minimal delivery record: your email, the identifier or picks you supplied at checkout, and the Stripe transaction reference, so we can deliver what you paid for and honor it later); uploaded exports (a derived, title-free viewing history kept for the limited periods stated there); accounts (the lists you save or buy, your saved taste, and the inputs of runs made while signed in, which are also used to improve our recommendations and models unless you switch that off on your account page, which deletes them); and gift purchases (the generated recommendation package is stored so it can be shown to your recipient). 2. Acceptance and Privacy

By accessing or using the Service, you confirm that you have read, understood, and accepted these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

3. Your Data and Your Responsibility

The Service runs entirely on data you supply. By submitting any input, you represent and warrant that:

  • You agree that you have the right to access and share the data you input into the Service.
  • The data you enter is your own, or you are otherwise lawfully entitled to use it (for example, a gift recipient's public profile identifier shared with their knowledge).
  • You bear full legal responsibility for the inputs you provide and for your use of the resulting recommendations.

We reserve the right to refuse or terminate service in cases of unlawful use, abuse, automated scraping of the Service, or attempts to disrupt its operation.

4. Entertainment Purposes Only

All recommendations are provided for entertainment purposes only. They are AI-generated suggestions, not professional, financial, medical, psychological, or any other form of advice. We make no guarantee that any recommendation will match your taste or expectations.

5. No Third-Party Affiliation

Lumitone is an independent service. We are not affiliated with, endorsed by, or sponsored by any third-party media or music platforms. Any third-party names or links that may appear in results belong to their respective owners and are provided only for your convenience.

6. Accounts (Optional)

You can use every part of the Service without an account. If you choose to sign in, you do so with a one-time link sent to your email address or with Google; there are no passwords. You are responsible for keeping access to that email address and for what happens under your account. One person, one account. A purchase made with an email address is attached to the account that uses the same address. You may delete your account at any time from the account page, which removes your saved lists and inputs; purchase records are kept for accounting without your email address. We may suspend or remove an account used to abuse the Service.

Purchases never require an account: delivery and access to what you bought also work through the email address you used and the links we send to it, as described in the Privacy Policy.

7. Purchases and Payments

  • Paid products are digital goods generated and delivered instantly (in-app, by email, or via a gift link).
  • Payments are processed by our payment provider; we never see or store your card details.
  • Prices may change at any time; changes do not affect purchases already completed.
  • Refunds are governed by our Refund Policy.

8. Intellectual Property

The Service, including its models, software, design and branding, is owned by us and protected by applicable intellectual property laws. You may use recommendation results for personal, non-commercial purposes. You may not copy, resell, reverse engineer, or create derivative works from the Service itself.

9. Service Availability

We aim for high availability but provide the Service "as is" and "as available." We may modify, suspend, or discontinue any part of the Service at any time. Real-time processing means results are generated at the moment of your request; past results are not retrievable from us because they are not stored, with two exceptions: gift packages, which are retained to deliver them to your recipient, and purchases made from an uploaded Letterboxd export, which can be re-shown while the purchase record and its derived history are kept (see the Privacy Policy for exactly what that is and for how long).

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, nor for the content or practices of third-party sites linked from results.

12. Termination

You may stop using the Service at any time, and you may request deletion of your purchase and gift data by emailing us (see the Privacy Policy). We may suspend or terminate access for violation of these Terms. Sections that by their nature should survive termination (including Sections 4, 5, 10, and 11) survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes are indicated by the "Last Updated" date above. Continued use after changes constitutes acceptance.
